Workshop on Patent strategies

Dr. Usharani and Dr. Poornima represented Prometheus IP services at a workshop on patent strategies for Europe held in Hyderabad on 16 Jan 2019. The workshop aimed at Pharma and Biotech sectors was conducted by Boehmert & Boehmert, an IP law firm from Germany.

The first session by Mr. Björn Bahlmann addressed, “Avoiding Trade dress issues in Germany” for pharma and medical products. The speaker elucidated on protection of Trade dress  which is not defined by German IP laws through means such as Copyright, Trademark, Design and Unfair Competition law.

This was followed by a session on second medical use claims by Dr. Markus Engelhard. Patentability, Infringement and Enforcement issues for second medical use claims were discussed through various case laws.

The final session by Dr. Carl-Richard Haarmann focused on Patent litigation in Germany. He elucidated upon the bifurcated patent litigation system, where infringement and validity issues are addressed by different courts through a case study.

This interactive workshop on nuances of patent strategies provided us new insights regarding the approaches that needed to be considered during IP prosecution to avoid and troubleshoot potential litigation and infringement issues in Germany.
