PCT National Phase Filing

Intellectual property rights are territorially limited. Securing the Patent rights in one country does not provide effective protection in other countries. This is due to the fact that each country has its own IP legislation.

A PCT (Patent Cooperation Treaty) Application by itself does not provide protection in all countries, it allows an applicant for seeking Patent protection in multiple countries by filing a single international application, which provides a total of 30/31 months’ time from priority date to prepare and file in over 152 PCT contracting states.

Before filing outside priority country, one has to select the countries in which they would like to protect their invention in case of:

Look for large markets for expansion
Markets more valuable for the invention

Applicant and Inventor details
A copy of the application documents as filed
A power of attorney (if required, some countries do not require POA)
Any amendments filed in the PCT
Preliminary Examination Report by WIPO
International Search Report
Certified priority copy
